HENNA TATTOO LIABILITY WAIVER & RELEASE

West River Holiday Tree Lighting Ceremony

I, the undersigned participant, or the parent/legal guardian of the minor participant listed below, acknowledge and agree to the following terms in consideration of receiving a henna tattoo at the West River Holiday Tree Lighting Ceremony on December 19, 2025.

Assumption of Risk

I understand that henna tattoos involve the application of a topical dye to the skin and that individual reactions may vary. I acknowledge that risks may include, but are not limited to, skin irritation, allergic reactions, itching, redness, swelling, discoloration, or other unforeseen skin sensitivities. I voluntarily assume all risks, known and unknown, associated with receiving a henna tattoo.

Medical Acknowledgment

I confirm that I (or the minor participant) do not have any known allergies, skin conditions, or medical issues that would make participation unsafe, or I have chosen to proceed despite such conditions. I understand it is my responsibility to disclose any known sensitivities prior to application.

Release of Liability & Hold Harmless Agreement

I hereby release, waive, discharge, and hold harmless West River Development, the event host, event organizers, property owners, sponsors, volunteers, contractors, and all henna artists and vendors associated with this event from any and all claims, demands, damages, injuries, losses, or causes of action arising out of or related to the henna tattoo application, including but not limited to skin reactions or aftereffects.

Indemnification

I agree to indemnify and hold harmless all released parties from any claims brought by or on behalf of myself or the minor participant, including reasonable attorney’s fees, arising from participation in this activity.

Consent for Minors

If the participant is under 18 years of age, I certify that I am the parent or legal guardian of the minor and that I consent to the minor receiving a henna tattoo under the terms of this waiver.

Voluntary Participation

I acknowledge that participation is entirely voluntary and that I may decline or stop the service at any time.

Governing Law

This waiver shall be governed by and construed in accordance with the laws of the State of Florida.
