Liability Waiver, Assumption of Risk, Indemnification & Media Release
1. Acknowledgment and Assumption of Risk
By registering for, entering, attending, or participating in the West River Fall Festival, including any activities, attractions, demonstrations, or services provided by participating vendors, I acknowledge that participation may involve certain inherent risks, including but not limited to bodily injury, illness, allergic reactions, animal bites or scratches, falls, property damage, or other unforeseen incidents.
These risks may arise from activities including, but not limited to, petting zoos, animal interactions, bounce houses, inflatable attractions, games, recreational activities, food and beverage consumption, entertainment, and other vendor-sponsored activities.
I voluntarily assume all known and reasonably foreseeable risks associated with my participation and the participation of any minors for whom I am legally responsible.
2. Release of Liability and Hold Harmless Agreement
To the fullest extent permitted by Florida law, I, on behalf of myself and, to the extent legally permitted, any minors for whom I am the parent or legal guardian, hereby release, waive, and discharge the following parties from claims arising from ordinary negligence in connection with the event:
This release is intended to apply to claims for personal injury, illness, property damage, or other losses arising from participation in or attendance at the West River Fall Festival, including activities and attractions operated by third-party vendors.
This release does not apply to claims that cannot legally be waived, including claims involving gross negligence, reckless misconduct, or intentional wrongdoing.
3. Petting Zoo, Animal Interactions & Activity-Specific Risks
I understand that participation in the petting zoo and other interactive attractions involves additional risks, including animal bites, scratches, kicks, allergic reactions, exposure to animal-related germs, falls, and other potential injuries.
I acknowledge that animals may behave unpredictably, even when supervised by trained handlers.
I agree to follow all posted safety instructions and directions provided by event staff, animal handlers, vendors, and attraction operators. I understand that children must be appropriately supervised by a parent or responsible adult.
By signing this waiver, I voluntarily accept the inherent risks associated with these activities and agree that the released parties identified above shall not be held liable for injuries or losses arising from ordinary negligence, to the fullest extent permitted by law.
4. Vendor and Contractor Activities
I understand that certain festival attractions, products, food, services, and activities are independently provided or operated by third-party vendors and contractors.
I acknowledge that DASH Coordinating & Marketing, LLC, Tampa Housing Authority, West River Development, and their respective partners and affiliates may not directly supervise or control the daily operations, equipment, animals, products, or services provided by these independent vendors.
I agree to comply with all applicable vendor rules and safety requirements.
To the fullest extent permitted by law, I release the parties identified in Section 2 from claims arising from ordinary negligence associated with these activities, subject to the limitations stated in this waiver.
5. Parent or Guardian Consent for Minors
If I am attending or registering with a minor child, I certify that I am the child's parent or legal guardian, or otherwise have the legal authority to provide the consents stated in this agreement.
I acknowledge responsibility for supervising the minor's participation in festival activities and ensuring compliance with all posted safety instructions.
I understand that Florida law may limit the enforceability of liability waivers signed on behalf of minors and that this agreement is intended to apply only to the extent permitted by applicable law.
6. Media Release and Photography Consent
By registering for and attending the West River Fall Festival, I acknowledge that photographs, video recordings, audio recordings, and other media may be captured during the event.
I hereby grant DASH Coordinating & Marketing, LLC, Tampa Housing Authority, West River Development, and their respective partners, sponsors, and affiliates the unrestricted, royalty-free right and permission to use my name, likeness, image, voice, and appearance in photographs, video recordings, and other media captured during the event.
These materials may be used for promotional, marketing, advertising, social media, website content, press releases, community engagement, and other lawful purposes, in perpetuity, without compensation or further notice.
I understand that event media created by or for the event organizers may be edited, published, reproduced, or distributed at their discretion, subject to applicable law and third-party rights.
If I am the parent or legal guardian of a minor, I also consent to the use of that minor's image, likeness, and voice for the purposes described above.
If I do not wish to be photographed or recorded, I may notify event staff upon arrival so reasonable efforts can be made to accommodate my request.
7. Indemnification
To the extent permitted by applicable law, I agree to indemnify and hold harmless the released parties from third-party claims, damages, or expenses arising from my own negligent, reckless, or intentional misconduct or my violation of event safety rules.
This provision does not require me to indemnify any party for that party's own negligence or misconduct.
